Expert testimony is crucial in helping tribunals understand complicated facts, technology, and science in a dispute. Finding, selecting and optimally utilizing experts, and effectively challenging the testimony and opinions of your opponent’s experts, can mean the difference between success and failure in your arbitration. This panel of experienced disputes lawyers and an expert witness will help you develop winning expert strategies in arbitration and litigation.
Topics to be discussed will include identifying issues requiring expert evidence; determining the types of experts needed; selecting non-testifying experts to assist with your understanding of technical issues, case development and strategies vs. finding and utilizing independent testifying experts; strategies and preparation for undermining opposing experts’ opinions and testimony including through cross-examination; use of joint expert statements and witness conferencing; managing time and cost expectations in the use of experts; the importance of the tribunal regulating issues on which expert evidence may be adduced; strategies for approaches to tribunal-appointed experts; due process issues in the hearing and standards for evaluation of expert evidence.
